Redemption Catalogue Terms & Conditions
These Redemption Catalogue Terms and Conditions (the “Catalogue Terms”) govern the redemption and use of Brilliant Award Points for vouchers, credits, products, services, experiences or other benefits (collectively, “Redemption Items”) made available through the Brilliant by Langham redemption catalogue (the “Redemption Catalogue”). Participation in the Redemption Catalogue is subject to the Brilliant by Langham Programme Terms and Conditions (the “Programme Terms”), which are incorporated herein by reference.
By accessing, browsing or redeeming through the Redemption Catalogue, Members agree to be bound by these Catalogue Terms. Capitalised terms not defined herein shall have the meanings ascribed to them in the Programme Terms.
1. Application and Hierarchy of Terms
1.1 These Catalogue Terms apply to all redemptions made through the Redemption Catalogue.
1.2 Each Redemption Item shall be subject to any additional terms and conditions applicable to such item, including without limitation conditions relating to validity, use, booking, availability, cancellation, exclusions and restrictions as set out in the applicable redemption voucher (a “Redemption Voucher”, and the specific terms and conditions applicable to that Redemption Item are the “Voucher-Specific Terms”).
1.3 In the event of any inconsistency, except where expressly stated otherwise:
1.3.1 the Voucher-Specific Terms shall prevail in respect of the relevant Redemption Item;
1.3.2 these Catalogue Terms shall prevail over the Programme Terms; and
1.3.3 the Programme Terms shall apply in all other respects.
1.4 For the avoidance of doubt, Redemption Items form part of Brilliant’s promotional programme, which is subject to modification, suspension or withdrawal at any time, and do not constitute contractual entitlements, vested rights, or legally enforceable benefits independent of these Catalogue Terms, the Voucher-Specific Terms and the Programme Terms.
2. Programme Nature and Availability
2.1 Redemption Items are made available at the discretion of Brilliant and may be modified, substituted, limited, or withdrawn at any time, subject to applicable law.
2.2 The earning of Brilliant Award Points and participation in the Redemption Catalogue do not guarantee the availability of, or entitlement to, any Redemption Item. All Redemption Items are offered at Brilliant’s discretion and are subject to availability.
2.3 Without limitation, Brilliant reserves the right, at any time and in its discretion and to the extent permitted by applicable law, to limit the quantity of any Redemption Item available for redemption, impose conditions or restrictions on redemption, withdraw or discontinue any Redemption Item without prior notice.
Redemption Mechanics
3.1 Only Members whose accounts are valid, active and in good standing are eligible to redeem Redemption Items using Brilliant Award Points. Brilliant Award Points have no cash value.
3.2 Redemption requirements, including the number of Brilliant Award Points required and the value or description of Redemption Items, may vary and are subject to change by Brilliant at any time, in its discretion.
3.3 A redemption shall be deemed completed and final upon the earlier of:
3.3.1 deduction of the applicable Brilliant Award Points from the Member’s account; and
3.3.2 issuance of the relevant Redemption Item.
3.4 Except as expressly provided under these Catalogue Terms or the Voucher-Specific Terms, and to the extent permitted by applicable law, all redemptions shall be final and may not be amended, refunded reversed or exchanged.
4. Redemption Vouchers
4.1 Redemption Items shall be fulfilled through the issuance of a Redemption Voucher, which may be provided in a digital formincluding without limitation, a voucher, QR code or email confirmation.
4.2 Each Redemption Voucher:
4.2.1 shall be valid only for the redemption of the specific Redemption Item stated;
4.2.2 shall be subject to the applicable Voucher-Specific Terms; and
4.2.3 shall be valid only within the stated validity period, and shall become void upon expiry.
4.3 Unless otherwise expressly stated, Redemption Vouchers:
4.3.1 have no cash value;
4.3.2 are non-transferable and personal to the Member;
4.3.3 may not be sold, resold, assigned, exchanged or redeemed for cash or any monetary equivalent; and
4.3.4 may not be used in conjunction with other promotions, offers or discounts.
4.4 Redemption Vouchers shall be void if they are altered, copied, misused, or used in breach of these Catalogue Terms and/or the applicable Voucher-Specific Terms.
5. Availability and Fulfilment
5.1 All Redemption Items are subject to availability and to the operational requirements and capacity of the relevant Participating Business Unit, including, without limitation, prior reservation or blackout periods.
5.2 All photographs and descriptions in the Redemption Catalogue are for illustrative purposes only and may differ from the actual products or services provided. To the fullest extent permitted by applicable law, Brilliant makes no representations or warranties regarding the accuracy, completeness, or reliability of such materials.
5.3 Where specified in the applicable Voucher-Specific Terms, prior reservation may be required. Members shall be responsible for making any required reservations directly with the Participating Business Unit.
6. Use and Presentation
6.1 Redemption Vouchers must be presented at the time of redemption and may not be applied retrospectively.
6.2 Members shall ensure compliance with all applicable Voucher-Specific Terms before and at the time of use.
6.3 To the fullest extent permitted by applicable law, failure to raise any issue at the time of redemption shall constitute acceptance of the goods or services provided.
7. Charges, Taxes and Additional Costs
7.1 Redemption Vouchers apply only to the specified Redemption Item and do not include any additional charges unless expressly stated.
7.2 Members shall be responsible for all applicable taxes, service charges, levies and incidental expenses, including without limitation any upgrades, add-ons or supplemental charges.
7.3 Where applicable, such applicable taxes, service charges, levies and incidental expenses may be calculated based on the prevailing retail value of the relevant goods or services prior to application of the Redemption Voucher.
8. Cancellation, Refund and Expiry
8.1 Cancellation or modification of Redemption Vouchers shall only be permitted where:
8.1.1 expressly provided in the applicable Voucher-Specific Terms; or
8.1.2 required by applicable law.
8.2 Where cancellation is permitted within the applicable cancellation time period and in accordance with prescribed procedures, as applicable:
8.2.1 the Redemption Voucher shall be cancelled; and
8.2.2 the corresponding Brilliant Award Points may be re-credited to the Member’s account, subject to verification and processing timelines.
8.3 Where cancellation occurs outside the applicable cancellation time period or does not comply with the prescribed procedures, or where a Redemption Voucher is not used in accordance with its terms:
8.3.1 the Redemption Voucher shall be deemed forfeited; and
8.3.2 no re-credit, refund, compensation or replacement shall be provided, except where required by applicable law.
8.4 Redemption Vouchers that expire unused shall be void and shall not be reinstated, extended or replaced.
9. Errors, Misuse and Fraud
9.1 Brilliant reserves the right to cancel, refuse, or reverse any redemption or Redemption Voucher in the event of:
9.1.1 any error, including without limitation pricing, technical or system errors;
9.1.2 any misuse, abuse or breach of these Catalogue Terms, the applicable Voucher-Specific Terms or the Program Terms; or
9.1.3 any suspected fraudulent, unlawful or abusive activity.
9.2 Brilliant may take such action as reasonably necessary in connection with the foregoing, including voiding, cancelling or refusing any Redemption Voucher, reversal or reclamation of any Redemption Items, adjustment of points balances, suspension or termination of accounts, in each case to the extent permitted by applicable law.
10. Participating Business Units
10.1 Redemption Items are provided, fulfilled and serviced by Participating Business Units, which may include independent third-party providers.
10.2 All goods and services shall be subject to the terms, conditions and policies of the relevant Participating Business Unit and applicable local laws.
10.3 To the fullest extent permitted by applicable law, Brilliant shall not be responsible for the performance, quality, availability or delivery of such goods or services, whether provided, fulfilled or serviced by Participating Business Units or independent third-party providers.
11. Limitation of Liability
11.1 To the fullest extent permitted by applicable law, Brilliant shall not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with the Redemption Catalogue or use of any Redemption Item, provided that nothing in these Catalogue Terms excludes or limits liability for death or personal injury resulting from negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
11.2 To the maximum extent permitted by applicable law, Brilliant's sole and exclusive liability arising out of or in connection with any Redemption Item shall be limited to re-crediting the Member's account with the same number of Brilliant Award Points redeemed for such Redemption Item. The Member shall have no entitlement to any cash refund, damages, compensation or other remedy and no monetary value or alternative valuation shall be attributed to the Brilliant Award Points for this purpose.
12. Amendments and Withdrawal
12.1 Brilliant reserves the right to amend, modify, suspend or withdraw any aspect of the Redemption Catalogue, including any Redemption Item or these Catalogue Terms, at any time, subject to applicable law.
12.2 Continued participation in the Redemption Catalogue after any amendment takes effect shall constitute acceptance of such amendments.
13. Governing Law and Local Compliance
13.1 These Catalogue Terms shall be governed by the laws of the Hong Kong Special Administrative Region. No third party may enforce any provision of these Catalogue Terms under the Contracts (Rights of Third Parties) Ordinance (Cap. 623).
13.2 Notwithstanding the foregoing, nothing in these Catalogue Terms shall exclude, limit or override any rights or remedies which cannot be excluded under applicable laws, including laws of the jurisdiction in which the relevant Participating Business Unit is located or any rights or protections afforded to Members under applicable consumer protection laws.
14. General Provisions
14.1 Brilliant reserves the right to interpret and apply these Catalogue Terms and Voucher-Specific Terms reasonably and in good faith, to the extent permitted by applicable law.
14.2 If any provision of these Catalogue Terms or Voucher-Specific Terms is held to be invalid, illegal or unenforceable, that provision shall be severed and the remaining provisions shall continue to be in full force and effect.
