GLOSSARY

TERMDEFINITION
Active MemberRefers to a Member who is Active. To be considered as “Active”, Members must earn any Brilliant Points at least once in the past twenty-four (24) consecutive months.
Award PointsRefers to a type of Brilliant Points earned by a Member according to a set scale which can be redeemed for Rewards.  
Benefit and PrivilegesRefers to the benefits and privileges to which a Member is entitled to under Brilliant, in accordance with the Terms and Conditions. 
BrilliantRefers to the Brilliant by Langham loyalty programme offered by Langham Hospitality Group.
Brilliant EventsRefers to events held at Participating Business Units, which include but are not limited to catering, banqueting or group events, meetings, or conference event.
Brilliant Member Dining DiscountRefers to a discount offered by Participating Business Units, which specifically limited to restaurants or bars only for the purposes herein. 
Brilliant Member RateRefers to a preferred room rate exclusive to Members.
Brilliant Mobile AppsMobile applications (including WeChat mini program) operated by or on behalf of Brilliant or otherwise in connection with Brilliant.
Brilliant PointsRefers to points generated by a Member according to a set scale, following a Qualified Spend. There are two types of Brilliant Points: (i) Award Points and (ii) Status Points.
Check-inRefers to the check-in process upon arrival at a hotel before a Stay.
Check-outRefers to the check-out process before departure from a hotel after a Stay.
CompanyRefers to Brilliant Loyalty Program Limited.
Conversion PartnersRefers to the partners that have formed partnerships with the Company for the conversion of Award Points into their respective program points such as airline miles. The list of Conversion Partners can be found on www.BrilliantbyLangham.com which may be updated by the Company from time to time. 
Elite Amenity PointsRefers to Award Points as a type of Elite Welcome Amenity in accordance with corresponding Membership Tier, in addition to any Awards Points earned on a Qualified Stay.
Elite Bonus PointsRefers to the additional Award Points to be received by the Members in accordance with their corresponding Membership Tiers when such Member earns any Award Points in accordance with the Terms and Conditions.
Elite Welcome AmenityRefers to one of the Benefits and Privileges in accordance with the corresponding Membership Tier.
Event ContractRefers to a written contract with the corresponding Participating Business Unit in relation to a Brilliant Event, which shall include (i) the name of the Member, (ii) the Membership number and (iii) the expected number of Brilliant Points to be earned upon completion and full payment of the Brilliant Event.
Hong KongRefers to the Hong Kong Special Administrative Region of the People’s Republic of China.
Langham Hospitality GroupRefers to Langham Hotels International Limited and its affiliates directly involved in the group’s management and operations of properties around the world, including hotels, residences, outlets, local management entities. 
MemberRefers to any person who is a member of Brilliant.
MembershipMeans the Brilliant membership of a Member.
Membership PeriodMeans a period of the Membership. The period commences on (i) the date joining Brilliant at the entry level or (ii) the date on which there is a change of Membership Tier (the “Commencement Date”). The period ends on the last date of a twelve (12) month period from the Commencement Date or upon an upgrade of Membership Tier, whichever occurs earlier.
Membership TierMeans the different membership tiers for Members as outlined in the Terms and Conditions.
Non-Participating Business UnitsRefers to the business units that do not participate in Brilliant, a list of which can be found in the Appendix to the Terms and Conditions and may be updated by the Company from time to time.
Non-Qualified Spends and ChargesRefers to the following spends and charges which are ineligible for earning Brilliant Points:
  • government and local taxes, service charge, gratuities, tips
  • accommodation related charges which are not displayed on the folio presented to a guest either for payment or signature.
  • any complimentary services  
  • banquet and event revenue (except as part of Brilliant Events)
  • cash paid out.
  • telephone and business centre charges.  
  • transportation charges  
  • miscellaneous charges  
  • non-qualified payment (example: eVoucher)
  • credit card surcharge.
  • health club spend.
  • laundry  
  • parking  
  • retail and gift shop purchases on property 
  • any tobacco related products 
  • charges on services which are contracted to a third party any spends and charges prohibited by applicable law where the hotel operates.
Non-Room RewardRefers to using the required Awards Points to settle the full payment of the bill at any Participating Business Units, except for payment in relation to Stays. 
Participating Business Units

Refers to the business units under the following brands which are owned, managed, franchised or licensed by Langham Hospitality Group and / or its affiliates:

  • The Langham Hotels and Resorts
  • Cordis Hotels and Resorts
  • Ying’nFlo
  • Eaton
  • Chelsea Hotel, Toronto
  • Chuan Spa
  • T’ang Court
  • Ming Court
  • Artesian  

but exclude the Non-Participating Business Units.

Privacy PolicyRefers to the privacy policy which can be found on www.BrilliantbyLangham.com and which may be updated by the Company from time to time.
Qualified ChannelsRefers to the Brilliant website (www.BrilliantbyLangham.com), the Brilliant Mobile Apps, and the Participating Business Units collectively.
Qualified Room RateRefers to a room rate at a Participating Business Unit (such as flexible rate, flexible rate with breakfast, advanced purchase rate and advanced purchase rate with breakfast, etc.) published on Qualified Channels, with details of each room rate.
Qualified SpendRefers to a Qualified Stay that includes any Qualified Charges.  See also section on Qualified Spend.
Qualified StayRefers to a Stay at one of the Participating Business Units booked through a Qualified Channel on a Qualified Room Rate. See also section on Qualified Stay.
RewardsRefers to any service, product or benefit or privileges redeemed by a Member by using the required number of Award Points, including Reward Stay and Non-Room Rewards. See also section on Redeeming Rewards
Reward StayRefers to a Stay at a Participating Business Unit redeemed by a Member by using the required number of Award Points.
Room Upgrade VoucherRefers to a voucher which a Member can, subject to availability, use to upgrade a reserved room to a higher category (one level higher) on a Qualified Stay.
Status PointsRefers to a type of Brilliant Points earned by a Member according to a set scale that will count towards qualification for the next higher Membership Tier or renewal of the current Membership Tier.
StayRefers to a room accommodation stay at the same Participating Business Unit, and one Stay can be one or more consecutive nights. For the avoidance of doubt, if there is a Check-in after a Check-out on the same date at the same Participating Business Unit, these stays (which are in essence consecutive nights at the same Participating Business Unit) will be considered as one Stay, regardless of the frequency of Check-in or Check-out.
U.S. DollarsRefers to the official currency of the United States of America.

Brilliant is operated in accordance with these terms and conditions govern your participation in Brilliant (“Terms and Conditions”).

By enrolling in Brilliant and participating as a Member, you acknowledge and agree:

a. You have read, understood and accepted the Terms and Conditions.

b. You understand and consent to the processing of your personal data (including your sensitive personal data and that of minors under your guardianship), and provision of such personal data to local and overseas recipients, in accordance with Privacy Policy.

c. You fulfil the eligible criteria as Member and Member information that you provide to the Company is accurate, current and valid. 

d. Membership is non-transferable and may only be used by the Member. Membership is strictly for each Member’s own personal use only. 

“Brilliant by Langham” is the loyalty programme offered by the Company which commenced on Thursday 29 February 2024. 

  1. Memberships, Brilliant Points and Rewards have no monetary face value and Brilliant Points do not constitute a means of payment, no matter how they were obtained (in other words, no money shall be provided for Brilliant Points, whether lost or unused Brilliant Points). Memberships, Brilliant Points and Rewards cannot be sold, bartered, transferred, exchanged for cash or otherwise by any means among the Members or between Member and non-Member. Any Brilliant Points or Rewards which are subject to an unauthorised sale, barter, transfer, or exchange will be forfeited and the Company shall have the right to terminate the Membership of the Member(s) involved. Upon such termination of Membership(s), all Benefits and Privileges shall cease forthwith, Brilliant Points or Rewards prior to termination of Membership(s) will be forfeited immediately and the Members involved will be liable for damages suffered or incurred by the Company. 
  2. Pooling of Brilliant Points for different Members are not permitted.s.
  3. The ownership and all rights to the Brilliant Points are exclusively retained by the Company at all times and throughout the entire duration of the Membership. While Members may earn Brilliant Points and redeem Award Points for Rewards, the Company maintains full control and authority over the Brilliant Points. Members acknowledges and agrees that the Company maintains absolute ownership and control over the Brilliant Points.
  4. Members are not entitled to hold more than one Membership. If a Member creates multiple Memberships, the Company reserves the right to merge and consolidate the details of the two (or more) Memberships, and Brilliant Points will be consolidated to one Membership in a way which the Company determines appropriate. The Company is not responsible for any loss of Brilliant Points or Benefits and Privileges and/or services due to a Member having multiple Memberships and merging and consolidation of such multiple Memberships by the Company.
  5. Members must earn the Brillant Points in accordance with the Terms and Conditions and shall not resell, make speculative, false or fraudulent reservations.
  6. Members are responsible for reading and understanding the Terms and Conditions, and other communications from the Company about Brilliant in order to understand their rights, responsibilities, and entitlement in Brilliant. Except as otherwise expressly prohibited or limited by applicable laws, the Company reserves the right to modify, alter, or update the Terms and Conditions with or without notice. If you continue to participate as a Member on or after the effective date of an update to the Terms and Conditions, you are agreeing to the updated Terms and Conditions. If a Member has any questions about Brilliant (including the Terms and Conditions), please contact the Company via email (enquiry@Brilliantbylangham.com)
  7. The Company reserves all rights to interpret the Terms and Conditions. 
  8. The Terms and Conditions is available in English, Traditional Chinese and Simplified Chinese. In the event of any discrepancy between the English version and other languages, the English version will govern.
  9. The Company reserves the right to change, limit, modify (whether its programme structure, benefits and other features, including the Terms and Conditions), suspend, or terminate the Brilliant.
  10. The Company requires Members to provide certain personal data for administration and continued operation of Brilliant and compliance with applicable laws and regulations. The Company is not responsible for any loss or failure to deliver any Membership associated Benefits and Privileges as a result of a Member’s failure to provide up-to-date data. This includes services such as Brilliant Points tracking, management and Reward issuance and redemption.
  11. The Company reserves all the right to
    1. correct or cancel any Brilliant Points shown in the Membership accounts,
    2. revoke or cancel any Brilliant Points received by the Members,
    3. correct or cancel any required Award Points posted for any Rewards,
    4. correct or cancel any booking or reservation based on an erroneously published Award Points required and refund the Award Points,
    5. correct or adjust any Membership Tier shown in the Membership accounts,
    6. withdraw or cancel any Benefits and Privileges related to the Membership,
    7. withdraw to award any Brilliant Points if there is any change of circumstances, or
    8. to otherwise correct any errors related to the Membership.

    Members will be notified if any of these events occurs. 

  12. Members acknowledge and agree that they are solely responsible for any unauthorized use or redemption of Award Points. Members shall also exercise utmost care and take necessary precautions to safeguard their Membership's information. Any unauthorized use or redemption of Award Points or unauthorized use of the Membership's information resulting from any actions or inactions by the Members shall be their sole responsibility, and the Company shall not be held liable for any losses or damages incurred due to these actions or inactions of the Members.

  13. Unless otherwise explicitly stated herein, all references to time and dates in the Terms and Conditions shall be based on the time and calendar observed in Hong Kong.

  14. For any currency conversions required under the Terms and Conditions, the applicable exchange rate shall be determined solely by the Company. The Company reserves the right to use its own selected exchange rate, which may be based on prevailing market rates or other factors deemed relevant by the Company at the time of conversion. Members agree to accept the exchange rate determined by the Company without dispute or challenge.

  1. There is no fee to join the Programme. It is open to individuals aged 18 years or above who:
    1.  has enrolled in Brilliant via the Qualified Channels and provided valid and accurate personal information and consents for enrolment;
    2. is not already a Member; and
    3. has not previously had their Memberships terminated by the Company as a result of him/her breaching the then prevailing Terms and Conditions.
  2. Member’s name on the Membership should match the Member’s legal identification (such as passport identity card, or other government official documentations).

  3. Upon enrolling in Brilliant successfully and participating as a Member, a Member will be eligible for Benefits and Privileges and be eligible to earn Brilliant Points in accordance with the Terms and Conditions. 

  1. Members can enjoy the Benefits and Privileges (including earning Brilliant Points and redeeming Award Points) at Participating Business Units only.

    The Company has the right to add, delete, update or modify the list of Non-Participating Business Units from time to time. It is the responsibility of the Members to look up the list of Non-Participating Business Units as the list of Non-Participating Business Units may not necessarily include all business units owned, managed, franchised or licensed by Langham Hospitality Group and / or its affiliates. 

  2. For the avoidance of doubt and as an example to illustrate, if a Member spends or receive services at a Non-Participating Business Units (even if booking was made when it had been a Participating Business Unit and subsequently become a Non-Participating Business Unit): 

    1. the Member will not be able to enjoy Benefits and Privileges and will not earn Brilliant Points; and
    2. the Member will not be able to redeem Rewards there. 

  1. Members can terminate their Memberships at any time by submitting a written request to the Company via email (enquiry@Brilliantbylangham.com), the Brilliant website (www.BrilliantbyLangham.com) or the Brilliant Mobile Apps and, upon receipt of the written request, the Company will contact such Members to confirm the termination of their Membership accounts.
  2. Upon the termination of Membership, all Benefits and Privileges of such Members shall cease and all their accumulated Brilliant Points prior to termination will be forfeited. A terminated Membership cannot be reinstated. 
  3. The Company has the right to temporarily suspend or permanently terminate the Membership immediately without notice or compensation to the Members, which will result in the cessation (temporarily or permanently) of any and all Benefit and Privileges, and (in event of suspension) suspension on use of Brilliant Points or (in event of termination of Membership) forfeiture of Brilliant Points if the Company believes (but this is not an exhaustive list):

    1. the Member has breached the Terms and Conditions.
    2. the Member has failed to pay for any charges, expenses, bills or account due to the Company, a Participating Business Unit or otherwise in relation to goods and/or services for Brilliant.
    3. the Member has acted in a manner inconsistent with any national, regional, or local laws or regulation.
    4. the Member has been involved in any misconduct, wrongdoing, abusive or fraudulent activities in connection with Brilliant, a Participating Business Unit or otherwise in relation to goods and/or services for Brilliant.
    5. Member’s withdrawal of consent to the Terms and Conditions.
    6. Member’s withdrawal of consent to processing of data in accordance with the Privacy Policy.
    7. Member’s failure to provide and maintain valid and accurate personal information in accordance with the Terms and Conditions.
    8. Member’s physical, verbal, or written abuse or harassment of hotel staff, customers, or any other person related to the services offered by the Company.
    9. Member’s abuse or misuse of any Benefits and Privileges, including but not limited to the sale or barter of any Brilliant Points, vouchers, rewards or other benefits.
    10. Member taking any other action or engaging in any other activities that are to the detriment of Brilliant, a Participating Business Unit as determined, in its sole discretion, by the Company.
    11. the Membership account is duplicated or unauthorized activity is discovered.
    12. the Member has ceased to be an Active Member for more than thirty-six (36) consecutive months; and
    13. Member’s fraudulent activities.
  4. Suspension or termination of any Membership by the Company shall be without prejudice to any other rights or remedies which the Company may have under applicable laws and regulations, all of which rights and remedies shall be cumulative and non-exclusive, to the extent permitted by applicable laws and regulations. Membership will be terminated upon the death of the Member. For the avoidance of doubt, upon termination of Membership, all Benefits and Privileges shall cease forthwith, and all accumulated Brilliant Points immediately prior to termination will be forfeited. Brilliant Points do not constitute personal property and may not be bequeathed or otherwise treated as personal property.

  1. There are different tiers of Membership, and each tier is determined by the Status Points accumulated by a Member as shown in the table below.

  2. The entry level of Membership Tier for Brilliant is Onyx. Upon successful enrolment of Brilliant, the Membership Tier of the Member is Onyx, and no Status Points is required. Members can move to a higher Membership Tier during their Membership if they accumulate the required number of Status Points within a Membership Period.
  3. If a Member accumulates the required number of Status Points for a higher Membership Tier within twelve (12) months from the beginning of the Membership Period, the current Membership Period will end immediately. In the new Membership Period, the Member will be in new Membership Tier, the number of Status Points required for this new Membership Tier will be deducted from the Membership account and the remaining balance of Status Points will be carried forward to the new Membership Period.
  4.  If a Member cannot accumulate the required number of Status Points to move to a higher level of Membership Tier during any Membership Period, the number of Status Points will be reset to zero at the end of the Membership Period. In the next Membership Period, the Membership Tier of Onyx will remain the same. For the other Memberships Tiers, they will (i) remain the same if the accumulated Status Points before resetting to zero are equal to or higher than the required number for the same Membership Tier or (ii) move one level lower if the accumulated Status Points before resetting to zero is lower than the required number for the same Membership Tier.
  5. Award Points earned or used by a Member do not determine the Membership Tier status.

  1. Members are entitled to earn Award Points and Status Points, collectively the “Brilliant Points”. No Brilliant Points can be earned from any expenditure made prior to successful enrolment as Members.
  2. Members must meet a minimum spend requirement of ten (10) U.S. Dollars (which could be converted to the local currency accordingly) in order to be eligible to earn Brilliant Points.
  3.  Members may earn one hundred fifty (150) Award Points and one hundred fifty (150) Status Points for every five (5) U.S. Dollars (which could be converted to the local currency accordingly) spent on Qualified Spend.
  4. Awards Points and Status Points are only earned for increments of five (5) U.S. Dollars.
  5. Brilliant Points earned through participation of Brilliant may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of Brilliant Points is the sole responsibility of the Member. Notwithstanding the foregoing, as the operator of Brilliant, the Company is required to cooperate with any tax and regulatory authority which may request for full details of any Member’s accrual and redemption of Brilliant Points, as Members may incur tax liability through use of Brilliant. The Company reserves the right to cooperate with any tax and regulatory authority without incurring any liability.
  6. Awards Points will expire on the date when a Member has ceased to be an Active Member. After the expiration of date of the Award Points, all accumulated Award Points in their Membership Account will be forfeited. Unless the Membership is terminated, such Member can still earn Award Points and become an Active Member again. For the avoidance of doubt, Award Points cannot be reinstated once they are forfeited even if the Member becomes an Active Member again.

  1. Members may earn Brilliant Points through any consumption in one of the Participating Business Units (including Qualified Stays) except the Non-Qualified Spends and Charges
  2. In order to earn the Brilliant Points through consumption in a Participating Business Unit, the Member must (i) be physically present in such Participating Business Unit, (ii) provide their Membership numbers during Check-in in the case of a Qualified Stay or present their digital membership cards prior to making any payments, and (iii) settle the payments by themselves (such as debit cards or credit cards under their names).
  3. Members cannot earn any Brilliant Points for any cancellations related to a Qualified Spend and no Brilliant Points can be earned on any cancellation fees.
  4. If a Participating Business Unit, at its sole discretion, considers that an Event Contract is required for the consumption through which Members intended to earn any Brilliant Points, such consumption will be considered as a Brilliant Event and the Terms and Conditions relating to Brilliant Events will apply (See also section on Brilliant Event). For the avoidance of doubt, Member will earn fifteen (15) Award Points and fifteen (15) Status Points (instead of one hundred fifty (150) Award Points and one hundred fifty (150) Status Points) for every five (5) U.S. Dollars (which could be converted to the local currency accordingly).

  1. In order to earn the Brilliant Points through a Qualified Stay, Members must (i) book the room under their names, (ii) occupy the room themselves, (iii) provide their Membership numbers during the booking or prior to Check-out and (iv) settle the payments by themselves (such as debit cards or credit cards under their names).  See also section on Earning Points on Multiple Rooms.
  2. If two (2) Members share the same booked room, they may earn Brilliant Points in proportion to the payments made by each of them, provided that the Members must request to split the bill during Check-out and each Member must fulfil the conditions required as if they were earning Brilliant Points without sharing the room, in accordance with the Terms and Conditions. 
  3. Members will not earn any Brilliant Point on bookings that are not made through the Qualified Channels or at Qualified Room Rates, and, as examples, there will be no Brilliant Points earned from the following:
    1. Complimentary rooms
    2. Bookings made via Third Party channel including and without limitation, Ctrip.com, Booking.com, Expedia.com and Fliggy.
    3. Rates provided by wholesales / tour operators.
    4. Airline or other passenger rates which are due to travel delays.
    5. Continuous stays of 14 nights or more, on a specific long stay agreement.
    6. Any booking where the Members do not settle the payments by themselves (such as debit cards or credit cards under their names) for the room upon Check-out. 

  1. A Member may earn Award Points on a Qualified Stay for up to three (3) rooms each night provided that the following criteria are met
    1. all rooms are made in the same reservation under the name of such Member at the same Participating Business Unit, booked through one of the Qualified Channels, on a Qualified Room Rate, with the same dates of Check-in and Check-out.
    2. the Member pays by themselves (such as debit cards or credit cards under their names) for all the rooms at the same time during Check-out.
    3. the Member must occupy one of the rooms with their designated guest(s) at the same Participating Business Unit on the same date(s).
  2. Members cannot earn any Award Points for Stays at multiple Participating Business Units for the same period. 
  3. Members may only earn Status Points for the room they occupy during a Qualified Stay, even if reservations have been made for more than one (1) room.  
  4. The Company reserves the right to cancel any reservation it believes to be in violation of the Terms and Conditions.

  1. Members may make a request to claim for Brilliant Points if they do not appear in their Membership accounts three (3) days after the corresponding transactions of a Qualified Spend.
  2. The request must be made within six (6) months of the transaction date or the Check-out date, as the case may be, by completing the “Missing Points” request form which can be found on the Brilliant website (www.BrilliantbyLangham.com) or Brilliant Mobile Apps.
  3. Members should allow four (4) to six (6) weeks for Brilliant Points to be credited if the claim is successful. The Company will contact the Members to keep them updated on the process or inform them if the claim is not successful.

  1. Subject to the Terms and Conditions, a Member is entitled to the following Benefits and Privileges in accordance with the corresponding Membership Tier:
    1. All Members can avail of a Member Rate when booking via the Brilliant Website, Brilliant Mobile App, Brilliant WeChat Mini-program, or by contacting the participating hotel directly. The Member Rate cannot be combined with any promotions, discounts, or other special offers.
    2. Elite Bonus Points
    3. Brilliant Member Rate
    4. Brilliant Member Dining Discount
    5. Elite Welcome Amenity
    6. Room Upgrade Voucher
    7. Late Check-out & Early Check-In
  2. Elite Bonus Points Members may, in accordance with their corresponding Membership Tiers, receive Elite Bonus Points (being Award Points) when earning any Award Points through Qualified Spend (except Brilliant Events). Elite Bonus Points are calculated as a certain percentage of the earned Award Points based on the following scale:

    The entry level of Membership Tier for Brilliant is Onyx. Upon successful enrolment of Brilliant, the Membership Tier of the Member is Onyx, and no Status Points is required. Members can move to a higher Membership Tier during their Membership if they accumulate the required number of Status Points within a Membership Period.For the avoidance of doubt, Members may not receive any Elite Bonus Points from Award Points that were not earned through Qualified Spend, such as Award Points granted to Members as gifts, goodwill gestures, or for marketing purposes. In other words, Elite Bonus Points will only be given to Members for the Award Points they directly earn. 
  1. Brilliant Member Rate 
    1. Members may enjoy a Brilliant Member Rate up to three (3) rooms per night at a Participating Business Unit booked through one of the Qualified Channels as indicated in these channels.
    2. The Member must pay by themselves (such as debit cards or credit cards under their names).
    3. The Brilliant Member Rate cannot be combined with any promotions, discounts, or other special offers. 
  2.  Brilliant Member Dining Discount
    1. Members may enjoy a Brilliant Member Dining Discount 
    2. Brilliant Member Dining Discount for Membership Tiers of Onyx and Topaz is five percent (5%) and Brilliant Member Dining Discount for Membership Tiers of Diamond and above is ten percent (10%).
    3. Brilliant Member Dining Discount is limited to a maximum of twenty (20) patrons for each bill.
    4. Members cannot use Brilliant Member Dining Discount and redeem Award Points in the same transaction.
    5. Members can enjoy Brilliant Member Dining Discount and earn Brilliant Points in the same transaction.
    6. Brilliant Member Dining Discount cannot be combined with any promotions, discounts, or other special offers.
    7. To enjoy Brilliant Member Dining Discount, Members must be present and request it at the time of settling the relevant bill, in any event before payment, and pay by themselves (such as debit cards or credit cards under their names).  
  3. Elite Welcome Amenity
    1. Members with Membership Tiers of Sapphire or above may receive an Elite Welcome Amenity on each Qualified Stay before Check-out.
    2. Subject to the level of Membership Tier, eligible Members may, subject to availability, choose one (1) type of Elite Welcome Amenities which include (i) Elite Amenity Points (being Award Points), (ii) one (1) welcome drink, (iii) food and beverage credits and (iv) one (1) brand gift product as follows:

    3. Choice of Elite Welcome Amenity can only made via the Brilliant Mobile App prior to Check-out and cannot be changed upon confirmation.
    4. Only one (1) Welcome Amenity is provided during each Qualified Stay.
    5. The Welcome Amenity must be used during the Qualified Stay; otherwise it will be forfeited and cannot be carried forward to the next Qualified Stay.
    6. If a Member has reserved multiple rooms during the Stay, the Member will be provided with only one (1) Elite Welcome Amenity and, if applicable, delivered to the room occupied by such Member.
  4. Room Upgrade Voucher
    1. A Member will be issued ONE Room Upgrade Voucher in each of the following situations:
      1. The Membership Tier of a Diamond Member moves up one level higher (i.e. Sapphire);
      2. The Membership Tier of a Sapphire Member moves up a higher level (i.e. Ruby);
      3. A Sapphire Member when they renew their Membership Tier in the next Membership Period; or
      4. A Ruby Member when they renew their Membership Tier in the next Membership Period.
    2. A Member can use a Room Upgrade Voucher to upgrade a reserved room by one category above on a Qualified Stay up to a maximum of three (3) consecutive nights, subject to availability.
    3. To upgrade a room using a Room Upgrade Voucher, a Member must use the voucher at the time of making a reservation for the respective room or during Check-in, subject to availability.
    4. Once room upgrade is confirmed by using the Room Upgrade Voucher at the time of making a reservation, Members can change their minds and withdraw from using the Room Upgrade Voucher before the Stay, subject to availability of the original reserved room type and the cancellation policy or reservation policy of the corresponding Participating Business Unit. Otherwise, the Room Upgrade Voucher will be considered as used. Upon successful withdrawal, the Room Upgrade Voucher will be returned to the Member within fourteen (14) days, and the reserved room will either (i) have no upgrade or (ii) be cancelled, as the case may be.
    5. The Room Upgrade Voucher is valid for twelve (12) months from the date of issue. The Check-in date of the Qualified Stay must fall within the validity period or otherwise the Room Upgrade Voucher will be forfeited. 
    6. If the reserved rooms are upgraded to executive floor room, club floor room or suite types accompanied with club access benefits by using Room Upgrade Vouchers, executive lounge or club access benefit is included.
    7. Members can accumulate up to four (4) Room Upgrade Vouchers in their Membership accounts.  
  5. Early Check-in & Late Check-out
    1. Subject to availability, Members may enjoy an early Check-in and a late Check-out on a Qualified Stay upon request with the corresponding Participating Business Unit.
    2. Ruby Members are guaranteed a late Check-out up to 4 p.m. upon request during Check-in with the corresponding Participating Business Unit except the following: Cordis Dongqian Lake-Ningbo, The Langham, Gold Coast and The Langham Huntington Pasadena, Los Angeles
  6. The Company reserves the right to amend the Benefits and Privileges at any time, without prior notice.
  7.  In case of any disputes in relation to the Benefits and Privileges, the Company reserves all the rights to interpret. 

  1. Members may redeem their Award Points for Reward Stays or Non-Room Rewards (collectively, the “Rewards”).
  2. Members must have sufficient Award Points in order to redeem the corresponding Rewards.
  3. When Members redeem Rewards, the number of required Award Points will be deducted from their Membership accounts.
  4. Members are not allowed to redeem Award Points in conjunction with any other offers or promotions unless specifically permitted at the time of redemption.
  5. Rewards cannot be exchanged for cash and is void if sold for cash or other consideration.
  6. Reward Stays:
    1. Members may redeem a Reward Stay by booking through a Qualified Channel. 
    2. A Member may redeem Award Points for up to a total of three (3) rooms per night during a Stay provided that the booking is made under the Member’s name and such Member is staying with their designated guest(s) at the same Participating Business Unit on the same dates. 
    3. The number of Award Points required for a Reward Stay may vary depending on various factors such as the brand and location of a Participating Business Unit, and the date for the booking. 
    4. Redeeming for a Reward Stay is subject to availability at the time of booking.
    5. Redeeming for a Reward Stay requires a credit card to guarantee the reservation and is subject to the guarantee and cancellation policies of the Participating Business Unit, including any relevant minimum length of stay requirements, charges for late cancellation, no-shows and early Check-out.  
    6. A Reward Stay is not a Qualified Stay. Members will not receive any Award Points or Status Points for the Reward Stay or the Reward Stay portion of a Stay.
    7. Members will receive all other relevant Benefits and Privileges for the Reward Stay as applicable.
    8. Reward Stays are not transferable, and the room must be occupied by the Member or, if multiple rooms are redeemed, the Member and the designated guest(s).
    9. When a Member redeems any Reward Stay, the Member agrees to make legitimate Reward Stay reservations in good faith for use by the Member and their designated guest(s) only, and not for any other purposes, including without limitation, reselling, posting on third party websites, or making speculative, false, or fraudulent reservations, or any reservation in anticipation of demand. The Company reserves the right to cancel any reservations it believes to be in violation of the Terms and Conditions.
    10. Any fraudulent conduct or misuse of Reward Stay, including but not limited to cancelling a Reward Stay reservation following Check-in, may result in forfeiture of Brilliant Points and/or other remedies permitted under the Terms and Conditions. 
  7. Non-Room Rewards:
    1. Subject to availability, Members may redeem Non-Room Rewards at Participating Business Units
    2. To redeem Non-Room Rewards, Members must request it at the time of settling the relevant bill, in any event before payment, to inquire the number of Awards Points required. If they agree to use the required Awards Points, Members can settle the bill by using the Award Points in their Membership accounts.
    3. Awards Points can only be redeemed against the full value of the bill, including taxes and service charges (but not gratuities) and cannot be used in conjunction with any discounts or promotional offers.
    4. The maximum value of Awards Points that can be redeemed in any one transaction is five thousand (5,000) U.S Dollars (which could be converted to the local currency accordingly). 
    5.  Award Point Conversion:
      1. Members may choose Award Point conversions via Brilliant website (www.BrilliantbyLangham.com) or the Brilliant Mobile app, details of which can be found on Brilliant website (www.BrilliantbyLangham.com).
      2. Separate terms and conditions will apply to Award Point conversion, and they can be found on Brilliant website (www.BrilliantbyLangham.com).
      3. Prior to Award Point conversion, it is the responsibility of the Members to ensure that their names in Membership accounts are exactly the same as their names in the membership accounts with the corresponding Conversion Partners and provide the necessary information such as their membership numbers of the Conversion Partners as required.
      4. The Company reserves the right to prevent or cancel any Award Point conversions where (i) the Company has reason to believe that the identity of the Member converting the Award Points to program points does not match the identity of the individuals receiving the program points or (ii) the Company suspects that there have been any fraudulent activities connected with the Award Point conversion in relation to the Membership account.
      5. Upon a request for Award Points conversion, the Award Points will be deducted immediately, and it will take four (4) to six (6) weeks for the corresponding program points to appear in the membership accounts with the corresponding Conversion Partners. Once a request for Award Points conversion is made, such request cannot be cancelled or withdrawn.
      6. Changes, reissuance, and recredit of Award Points are not allowed once Award Points are converted to the program points of the membership account of a Conversion Partner.
      7. The Company will endeavour to ensure the availability of products and / or services provided by the Conversion Partners, such as airline partners. However, the Company shall not be liable for any loss resulting from the failure of Conversion Partners to provide such products and/or services. Member using the products and / or services provided by a Conversion Partner must adhere to terms and conditions set forth by the Conversion Partner, and any potential loss incurred shall not be responsibility of the Company.

  1. Members may earn Brilliant Points through Brilliant Event. A Brilliant Event must be subject to an Event Contract.
  2. The number of Brilliant Points that a Member is entitled to in a Brilliant Event will be set out in the Event Contract. Members may earn fifteen (15) Award Points and fifteen (15) Status Points for every five (5) U.S. Dollars spent on Brilliant Event. The maximum value of Brilliant Points that can be earned on each Brilliant Event is fifty thousand (50,000) U.S. Dollars (which could be converted to the local currency accordingly)). Awards Points and Status Points are only earned for increments of five (5) U.S. Dollars. 
  3.  If the Member is not the contracting party in the Event Contract with the Participating Business Unit, such Member may still earn the Brilliant Points if written approval is obtained from the contracting party to authorise the Member to earn the Brilliant Points. 
  4. Brilliant Points will be credited to the Members between two (2) to four (4) weeks upon completion of the Brilliant Event and after full payment in accordance with the Event Contract.
  5. A Member cannot earn any Brilliant Points if the Brilliant Event is cancelled and no Brilliant Points can be earned on any cancellation fees.
  6. A Member may earn Brilliant Points on two (2) or more Qualified Events over the same dates at the same Participating Business Unit but these events will be considered as one Qualified Event and subject to the maximum Brilliant Points of fifty thousand (50,000) U.S. Dollars (which could be converted to the local currency accordingly) that can be earned for one (1) Brilliant Event.
  7. Members acting as a third-party intermediary and claiming commission or management fee on bookings are not eligible to earn Brilliant Points through Brilliant Events. For the avoidance of doubt, such Members are still not eligible to earn Brilliant Points through Brilliant Events, even if they have been duly authorised by the contracting party in the Event Contract.

  1. Members may choose different options on whether to receive Brilliant communications and what Brilliant communications they receive. Members will (subject to the giving of necessary consents or permissions to the Company) receive Brilliant communications including but not limited to Brilliant Point balance updates, promotions, offers or third-party communications from time to time, in accordance with the Privacy Policy.
  2. Members can review their Brilliant Points balance and transaction history in their Membership account profile which can be found after logging into their Membership account via the Brilliant Mobile Apps or Brilliant website (www.BrilliantbyLangham.com).  
  3. Members may change personal details and communication preferences at any time in their Membership account profile which can be found after logging into their Membership account on Brilliant Mobile Apps or Brilliant website (www.BrilliantbyLangham.com).
  4. In order to change the name on the Membership account, the Member must contact the Company via email (enquiry@Brilliantbylangham.com).

  1. By enrolment of and participation in Brilliant, the Member understands and accepts the Privacy Policy, and explicitly authorise the Company, in its capacity as data controller, by its subsidiaries, affiliates, and/or agent to collects, uses, and discloses personal information of the Member in accordance with the Privacy Policy. 

  1. EXCEPT FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE AND TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, THIS COMPANY, ITS SUBSIDIARIES AND ITS AFFILIATES, PARTICIPATING BUSINESS UNITS AND CONVERSION PARTNERS (INCLUDING AIRLINE PARTNERS)(AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS) (“BRILLIANT PARTIES”) ASSUME NO LIABILITY TO YOU FOR ANY DIRECT, INDRIECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH BRILLIANT OR OPERATION OF OR PARTICIPATION IN BRILLIANT.
  2.  TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, MEMBERS AGREE TO RELEASE THE BRILLIANT PARTIES FROM ANY DIRECT OR INDIRECT LOSS, CLAIMS, COSTS, DAMAGES OR EXPENSES OF ANY KIND WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH HIS OR HER MEMBERSHIP.
  3. BRILLIANT PARTIES MAKE NO GUARANTEES, WARRANTIES, OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, THAT THE INFORMATION RELATED TO THE PROGRAMME IS ACCURATE, COMPLETE, REALIABLE, UPDATED.
  4. BRILLIANT PARTIES WILL NOT BE LIABLE FOR ANY ACTS, ERRORS OR OMISSIONS OF ANY OTHER MEMBER, A THIRD PARTY OR ANY PARTNERS.
  5. TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, THE TOTAL AGGREGATE LIABILITY OF THE BRILLIANT PARTIES TO YOU, REGARDLESS OF THE CAUSE OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED TEN (10) U.S. DOLLARS.
  6. THIS LIMITATION OF LIABILITY WILL SURVIVE THE TERMINATION OF BRILLIANT AND YOUR MEMBERSHIP IN IT.

  1. Members shall release and indemnify Brilliant Parties against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by Brilliant Parties arising out of or in connection with their participation in Brilliant including but not limited to any failure to declare any benefits received on the Brilliant Event or for breach of any applicable law and regulation, gift and incentive policy, guideline or compliance requirements.

  1. The Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong.
  2. Unless otherwise required by applicable laws, all and any dispute, controversy, claim or difference of any kind whatsoever arising out of or relating to the Terms and Conditions against or relating to the Company or any affiliate of the Company under the Terms and Conditions shall be referred to and finally resolved by arbitration in Hong Kong in accordance with the Arbitration Rules of the Hong Kong International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this section. The dispute will be decided by a sole arbitrator jointly appointed by the parties. The language of the arbitration shall be English and the venue shall be Hong Kong. The Company shall have the right in a proper case to obtain temporary restraining orders, temporary or preliminary injunctive relief, and/or declaratory relief from a court of competent jurisdiction.
  3. A person who is not a party to the Terms and Conditions shall not have any rights under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any term of the Terms and Conditions.

  1. Brilliant, operation of and the participation in Brilliant, and the earning and redeeming of Brilliant Points are subject to all applicable local laws and regulations. Membership, Benefits and Privileges, and Rewards are offered in good faith, and they may not be available if prohibited or restricted by applicable law or regulation. 
  2. If any part of the Terms and Conditions is held to be unlawful, invalid, or unenforceable, that part will be deemed deleted from the Terms and Conditions in such jurisdiction and remaining part shall remain in full force and effect. 

  1. THE COMPANY RESERVES ALL THE RIGHT TO SOLELY INTERPRET THETERMS AND CONDITIONS.
  2. The Company retains its right to exercise or enforce any right contained in the Terms and Conditions. No failure or delay on the part of the Company in exercising any right or remedy hereunder or enforcing the Terms and Conditions will operate as a waiver thereof.

  1. The Terms and Conditions constitute the entire and exclusive agreement between the Member and the Company with respect to Brilliant. The Terms and Conditions supersede all prior or contemporaneous communications, agreements, advertising, and proposals, whether electronic, oral or written, with respect to Brilliant.
